Late Friday afternoon provided your weekend conversation-starter. Out of nowhere, came the bombshell, first reported by Pat Forde of Yahoo Sports, that a new book makes allegations that a former Louisville assistant basketball coach paid for escorts to have sex with basketball recruits. In fact, U of L has been conducting an internal investigation into those allegations. The book, “Breaking Cardinal Rules: Basketball and the Escort Queen,” is being published by IBJ Book Publishing of Indianapolis. The book is written by Louisville resident Katina Powell – a self-described madam who allegedly provided girls to the Louisville team – and Indianapolis-based journalist Dick Cady. Powell alleges that former graduate assistant and director of operations Andre McGee paid her thousands of dollars over a four-year period to provide women to dance for and have sex with Cardinals basketball players – often in the players’ on-campus dorm.

This isn’t the first time that a sex scandal has been linked to Louisville basketball. Head coach Rick Pitino had his own personal and infamous sex scandal not that long ago.

The agreement was effective Sept. 1, the day after the book's coauthor, Dick Cady, said he met with U of L officials. It was signed a week later by Kevin Miller, U of L's executive senior associate athletic director for internal operations. Smrt signed the contract on Sept. 11.

The funding for Smrt's investigation will come out of the basketball program's budget...

Louisville lawyer Nader George Shunnarah, who is asking that the suit be designated a class action on behalf of all U of L students, could not be reached for comment. But he told an online news site that “the goal here is to benefit students instead of the prostitute.”

The suit asks that all profits from the book be placed with a receiver in the Jefferson Circuit Court clerk's office.

But Jon Fleischaker, a leading First Amendment attorney, said the suit, filed Thursday in Jefferson Circuit Court, is meritless and raises serious constitutional questions.

“Whatever you think of Katina Powell, she has a First Amendment right to write about whatever she wants and it appears that at least some of what she wrote is true,” said Fleischaker, who represents the Kentucky Press Association and The Courier-Journal.

“This is a silly lawsuit,” Fleischaker said.

The complaint was filed on behalf of Kyle Nicole Hornback, who said in an email that she is 19 and a sophomore.

It asks a judge to order all profits from “Breaking Cardinal Rules” placed with a receiver in the Jefferson Circuit Court clerk's office and ultimately given to U of L students.

Here is the thing about Pitino -- he isn't as involved off the floor in players' lives as the PR arm of Louisville would lead you to believe. In fact one coach told me that Pitino typically was gone from the KFC Yum! Center before his team had boarded their bus after the game. Pitino had, in his mind, checked out on his team over the past couple of years, when the light of the TV cameras weren't on him.

I think he did not know. I also think it doesn't actually matter...

Well, Pitino just couldn't make media day.  He's going to be busy trying to line up a new group of escorts to help with recruiting.  Pitino says that he's going to have stricter rules from now on.  No escort sex for recruits Dad's......only players.   ;)

It's all about creating a "family atmosphere" for recruits. Louisville has just taken a more well rounded approach where the recruit also gets to be the daddy or have the naughty step parent/sibling they have seen so much of on the interwebz.

Yeah, but on the flip side, Pitino is about the only college coach whose ego is on the same level as Calipari's, so you know Slick John is just giddy inside that his rival (former mentor) is having to go through this.

Rick Pitino had answered about 15 minutes worth of questions about the University of Louisville basketball team’s opener with Wake Forest and its prospects for ACC play when the usual “last question” notice was given. And that last question was: “Did you flip off fans after the Kentucky game?”

Pitino more or less said that he did not, maybe. It sounded as if, actually, he might’ve allowed that he flipped off something else, the air, perhaps, who knows? He didn’t stay on the topic long. Because he had other things he wanted to discuss.

As you might assume, the things Pitino said on Friday afternoon were a long time coming. Katina Powell’s allegations — that she provided strippers and prostitutes for Louisville players and recruits and was paid by former Louisville director of basketball operations Andre McGee for the services from 2010 to ’14 — are only part of Pitino’s frustration. On Friday, he expressed qualms with the coverage of those allegations.

She can’t complete two sentences the right way to write a book.”

Pitino was relating what was told to him. Whether the quote is accurate, or to what it exactly referred -- the book or the journals themselves -- isn’t known. WDRB couldn’t reach officials at IBJ Book Publishing for comment, but Powell’s attorney, Larry Wilder, says those statements are inconsistent with anything the publisher ever has expressed about her in the past.

“I find it difficult to believe that anyone at IBJ would have been as hateful and mean-spirited about Ms. Powell as Coach Pitino has stated,” Wilder said in a text message exchange. “During my meetings with IBJ staff and ownership they have all been very respectful of her and her family. These gratuitous statements are clearly offered as a distraction to the truth.”

It was just the beginning of a 300-word statement from Wilder.

“Unfortunately, tragically, what Ms. Powell said took place at the university took place,” he said. “I appreciate Coach Pitino’s position. I understand he is hopeful that these things didn’t take place. However, the NCAA will render their opinion when they complete their full investigation and I am confident that their opinion will be reflective of the totality of the evidence and the circumstances. Ms. Powell continues to stand by her journals, her statements and the statements of those who have been interviewed by journalists, investigators and other lawyers. I am certain that the fraternity of ‘U of L basketball’ is as closely knit as any other. However, we have all been recent witnesses to just how far members of the ‘brotherhood’ will go to protect one another.”

The trick Louisville President James Ramsey is attempting is to cop a plea that shows contrition but not surrender, to fall on his sword, but only far enough for a flesh wound.

In announcing a one-year postseason basketball ban Friday afternoon, Ramsey sent the message that the infractions committed at U of L are serious, but not so serious as to warrant multi-year sanctions. Though the self-imposed penalties met with widespread astonishment, some anger and coach Rick Pitino’s hyperbolic claim that they were “as harsh as anything I have ever seen in college basketball,” they were designed as damage control and might be the best of a set of bad options.

Assuming that there is at least some substance to Katina Powell’s claims of supplying strippers and prostitutes to enhance U of L’s recruiting efforts – an assumption Pitino shares --NCAA sanctions were inevitable. Though starting the penalty now makes victims of players who never participated in Powell’s parties, it could conceivably limit the length of her shadow on Pitino’s program...

Pitino didn't really break any new ground in the interview but asserted once again that former Louisville staffer Andre McGee acted alone and that he urged McGee to come forward and tell the truth about the alleged sex parties for players and recruits orchestrated by Katina Powell in Billy Minardi Hall.

Pitino reiterated he had one phone exchange with McGee after the news broke, and also sent McGee a text.

"I'll always love you but I want you to do one thing, just tell the truth," Pitino told McGee. "Because there's a criminal investigation going on right now, he can't tell the truth right now."

Pitino said he had several nephews who lived in Billy Minardi Hall and they were unaware of the alleged sex parties.

"At the time I had three nephews that lived in that dormitory," he said. "...Right away I went to them and I said, 'Did you ever see anything that went on in that dormitory?' and they said, 'Uncle Rick, if we saw anything we could come to you right away.'"

Pitino said he saw the dorm, built in honor of his late brother-in-law Minardi, who was killed in the 9/11 attacks, as a "sanctuary."

Both sources spoke to Outside the Lines on the condition of anonymity...

In October, five former University of Louisville basketball players and recruits told Outside the Lines that they attended the recruiting parties. One former recruit, who went on to play at Louisville, said that he had sex with a dancer after McGee paid her.

Another recruit, who ultimately signed to play elsewhere (LSU?), said of the parties: "I knew they weren't college girls. It was crazy. It was like I was in a strip club."

The school has advised the NCAA that it will eliminate 30 off-campus recruiting opportunities, two on-campus official visits and two basketball scholarships over the next three years.
 
That’s 34 self-imposed penalties in addition to the self-imposed withdrawal from the Atlantic Coast Conference and NCAA Tournaments that the program took in February.
 
Why?
 
That’s the question everybody has wanted answered since early October when Katina Powell published her book – “Breaking Cardinal Rules” – that alleges she provided strippers and prostitutes for parties at the U of L basketball dorm from 2010-14.
 
How much of Powell’s story is true?
 
It’s still too soon to say. U of L does not admit to any specific NCAA violations in the statement the university released at 1:30 p.m. Wednesday. The announcement was merely the latest inexorable bump in the story line.
 
Eventually we’ll see the official letter of allegations from the NCAA, followed by the university’s response to those allegations, followed by a hearing with the NCAA Infractions Committee, followed by the penalties the committee chooses to assess.
 
Know this: The more the university chooses to penalize itself, the more credible Powell’s story about a representative of the basketball program (allegedly former director of operations Andre McGee) paying for sex and strippers becomes.
 
Rick Pitino coached a team that defeated two teams that played in the 2016 NCAA Final Four. Self-imposing a post-season ban on the program this season was a harsher hit for the players, coaches and fan base than what U of L said it was adding to the penalty Wednesday.
 
Reputations were stained by the post-season hit. Dreams were dismissed. Achievements were denied. March was a dreary month around here.
 
The Damion Lee/Trey Lewis team was a team that was likely to join the six other ACC teams in the Sweet Sixteen – and possibly join the Syracuse and North Carolina team the Cards defeated in the Final Four.
 
That one stung – and will continue to sting.
 
The cut in 30 off-campus recruiting opportunities by the coaching staff? Pitino, assistant Kenny Johnson and the rest of the staff can overcome that. Recruiting is their specialty.
 
The critical stuff remains unchanged:
 
Will Rick Pitino continue as the Louisville coach? Will the NCAA add another year to the post-season ban? Is the Cardinals’ 2013 NCAA championship banner in jeopardy?

Too many times, board members said they felt blindsided by news, to the point where questions over votes of confidence were starting to become routine. Once that starts happening, the end is near.

John Calipari created quite the stir when he took some not-so-subtle jabs at Rick Pitino and Louisville for the sex scandal. While Cal didn’t mention Pitino or the school by name, anyone who can read between the lines knew what he was talking about.

“All I can tell you is this: if it happens on your campus and it happens with your assistants and those people, you probably have a good idea what is going on,” Calipari told Mike Lupica last week. “All I can say is most coaches have an idea if it happened on their campus.”

“You know, Terry, whether it’s Duke last month or whether it’s now us this month, these type of comments — you know, we’re here to build up the image of college basketball, not tear people down,” Pitino said. “I know my coach when I was playing didn’t know anything that was going on with my teammates on campus. Unless somebody was getting into trouble with the law, he didn’t know what was going on.”

“The one thing I don’t do is, I don’t live in a glass house and I don’t throw stones. We have a rule in the ACC amongst coaches, unless you’re praising each other and building each other up, keep it to yourself and mind your own business,” Pitino continued. “I don’t want to comment on what anybody says unless it’s upbeat and positive because I don’t live in a glass house.”

Terry pressed Pitino on the topic, asking him if he was offended by Calipari’s comments given his history at Kentucky. Pitino insisted that he’s only interested in helping other programs, not “throwing stones.”

“All I’m going to do is praise people, and I’ve said that about Kentucky. They do a great job with what they do, Duke does a great job, North Carolina, Kansas. All these people do a fabulous job at what they do. So, the only thing I’m interested in is taking care of my program and that’s it. Unless I’m helping my neighbor, yeah, I’m not throwing any stones.”

When asked if he’s looking for an apology from Calipari, Pitino said he might question him about it if their paths cross this summer.

“It’s just like the Duke thing last month. He says that’s not what he means. I don’t have time to find out what he meant or didn’t mean. If our paths cross this summer, I’ll question him on it. Outside of that, look, he — I take care of press conferences when I have to do them, I feel like it’s an obligation. I’m not looking to be in the press.”

The value of the impermissible inducements, offers and/or extra benefits was at least $5,400."

In all, the document details 14 strip shows, 11 sex acts and two declined sex acts.

The NCAA, along with U of L representatives, conducted more than 90 interviews with current and former players and recruits, parents, coaches and others involved in the case. The Notice of Allegations was delivered to the school on Monday. U of L released the document Thursday morning, and is expected to hold a news conference later today.

In a statement, acting president Neville Pinto and athletic director Tom Jurich said: "As parent and university leaders who care about every student who comes to the University of Louisville, we are heartbroken that inappropriate behavior took place here. It saddens us tremendously. We promised that if something was done wrong, we would be open about it, acknowledge it and correct it. . . . From the start, the NCAA Enforcement Staff had our full cooperation. Its staff and our investigators spoke to numerous Louisville employees and third parties, and the university produced every document requested by the NCAA. We are disappointed that former Director of Basketball Operations Andre McGee did not cooperate. These allegations underscore why it was appropriate for the university to self-impose strict penalties on our basketball program earlier this year."

The statement also notes that the notice aligns with the results of the university's inquiry. It further points out that, "The NOA does not contain an allegation that Coach Pitino had knowledge of what took place in the dormitory. The NCAA does not allege a 'lack of institutional control' at Louisville, a very severe allegation. The NCAA does not allege that there was a 'failure to monitor' against the institution, also a severe allegation. The NCAA does not allege that Coach Pitino 'failed to promote an atmosphere of compliance,' a serious allegation. The NOA does contain a narrower allegation -- which we will dispute -- that Coach Pitino failed to demonstrate that he monitored McGee. We believe that McGee acted furtively and note that the NOA does not indicate that any other university employee besides Mr. McGee had knowledge of these activities. We are confident in Coach Pitino and we know he is and always has been committed to NCAA compliance. The entire episode is a deep disappointment to all of us who love this university."

A Notice of Allegations is roughly akin to a complaint in a civil court proceeding. The allegations in the U of L’s notice are the result of interviews, several meetings with Powell and her attorneys, examination of her journals and records, and the examination of many records provided by U of L. They largely represent a collaborative effort between the NCAA, the school and its consultant, former NCAA enforcement staffer Chuck Smrt, president of The Compliance Group, a Kansas City-based firm that assists universities with NCAA issues.

The school released a redacted version of the notice this morning, and expects to hold a news conference today., with athletic director Tom Jurich, acting president Pinto and university consultant Chuck Smrt expected to be in attendance.

The allegations stemmed from claims by former Louisville escort Katina Powell that she provided strippers and prostitutes to men’s basketball players and recruits from 2010 to 2014.

Any penalties U of L receives would be in addition to those already self-imposed by the school, which include the postseason ban enacted last Feb. 5 and scholarship reductions and recruiting restrictions put into place on April 6, including the loss of two scholarships, 30 recruiting days and two official visits over the next two seasons.

The major questions still remaining, whether the school may have to vacate victories or even its 2013 NCAA championship, and whether Pitino could be subject to suspension, remain unresolved by the receipt of this notice.

1). HOW KATINA POWELL GOT INTO THE BASKETBALL DORM. In all of the responses from U of L to the NCAA’s Notice of Allegations on the Katina Powell sex-for-recruits scandal, none probably was more bizarre than the series of problems described in basketball Rick Pitino’s defense to the NCAA’s charge that he failed to monitor the program.

Powell described in her book how she and her girls would go through a side door into the dorm. But there had been little explanation of why security camera footage wasn’t available or why an alarm on the door didn’t go off.

Pitino’s attorney says the dorm’s video security cameras often weren’t working. The company charged with running the dorm provided the NCAA with nearly 1,000 pages of daily activity reports for the dorm. The response says, “A cursory review of those Reports shows that the security guard frequently noted that some of the security cameras were not working. It appears that malfunctioning security cameras was a frequent problem in 2013 and 2014. Thus, one of the front-line mechanisms for monitoring Minardi Hall was not fully functioning during the period of McGee's illicit activities.” Moreover, the company did not provide daily reports prior to 2013, leaving many of the years in which Powell alleges she held parties in the dorm not accounted for.

Moreover, then-director of basketball operations Andre McGee apparently had a means to disable the security alarm on a side door, through which Powell said she brought women to parties. “The door was supposed to be used only for emergencies and an alarm was supposed to sound whenever the door was opened,” according to the response. “However, McGee had a key that allowed him to disarm the alarm.”

The decision to give that key to McGee was made by a Louisville housing supervisor whose name has been redacted.

Beyond that, one resident told investigators that McGee brought strippers into the dorm late at night when the resident assistant was off duty and the security guard “ would usually literally be asleep at the door.”

Also from the report: “An Incident Report filed in 2012 strongly suggests that a security guard who worked at Minardi may have been willing to overlook strippers being brought into the dorm.”

The report then goes on to report an alleged sexual assault by this security guard, who was the subject of an incident report —

2. AT LEAST ONE RECRUIT SAYS HE PASSED ON LOUISVILLE BECAUSE OF THE STRIPPERS. More than one recruit told investigators that their “experience with the strippers was uncomfortable or embarrassing.” One recruit said McGee offered to send strippers to his hotel to entertain him, and he asked him not to, saying, “I know females that I go to high school with and we’re not trying to mess with any . . . older girls that look disgusting, that look like they carry diseases.”

4). THE SCHOOL STILL QUESTIONS ELEMENTS OF POWELL’S CREDIBILITY. The ship has sailed, for the most part, because the school has acknowledged that there were shows in the dorms and that Powell did provide strippers who performed sexual acts for players and recruits.

5).PITINO VEHEMENTLY DISPUTES THE ALLEGATION THAT HE DID NOT MONITOR McGEE. I’ll write more about Pitino’s response to the Notice of Allegations, but the NCAA essentially says that Pitino did not heed red flags when it came to what was going on in the basketball dorm, that he did not conduct regular spot checks or ask pointed follow up questions.

    To persuade some of the young men to tell them about the strip shows, the enforcement staff requested and obtained limited immunity from the Chairperson of the COL Limited immunity is an investigative tool used by the enforcement staff to elicit truthful information from student-athletes who may have been involved in NCAA violations which could jeopardize their eligibility to compete. In exchange for truthful information, the enforcement staff agrees not to put the student-athlete at-risk for losing his eligibility.

The names in those interviews are redacted, unfortunately, but their testimonies are still very entertaining (and often damning) despite the anonymity.

This wasn’t handing a recruit a fancy pair of wireless headphones that resulted in four years of probation going forward for the program.

This wasn’t fiddling with a high school transcript or arranging for a free steak and lobster dinner that will force Pitino to miss the first five games of the 2017-18 Atlantic Coast Conference season.

This was paying for sex for players and prospects who were sometimes 17 years old (or younger) —

Furthermore, not one student who later competed in the 2011-12 and 2012-13 seasons engaged in a sex act. Even if these student-athletes were technically ineligible, they would unquestionably have been reinstated.

    The University disputed the dollar values the NOA assigned to some of the “benefits.” In several cases the enforcement staff assigned different values to the same act—for instance, valuing a dance at $175 in one case and $125 in another—based on the fact that Powell had notated them differently in her journal.

    As the University explained, these differences were arbitrary, and the identical benefits should be valued similarly. It therefore determined, among other things, that had received benefits valued at $125, rather than $175, as the enforcement staff alleged.

Where a student-athlete receives a benefit of little value—such as a recruiting inducement worth $500 or less—the committee instructs that he should be reinstated without any loss of competition upon repayment.

It would be absurd, and grossly disproportionate, to hold that an individual who receives an unwanted and minor benefit during recruitment—say, a car ride worth $150—should have his entire collegiate record nullified if that conduct is discovered years later.

No prior decision has ever imposed vacation or disgorgement because of an extra-benefits or inducement violation for which the student-athletes bore such limited culpability, gained so little of value, and received no advantage...

“It’s truly a long process,” he said then. “You don’t want to rush it. You have to take your time. There are guys who are maybe staying in school, maybe going to the NBA. There are coaches getting fired. There are so many factors.

“I’m in a position now where I really understand.”

A few days later, he took a recruiting visit to Oregon.

Three weeks after that, Bowen was on U of L’s campus for a visit.

Five days later, he was committed to the Cardinals.

In an interview soon after with WHAS, U of L Coach Rick Pitino described the Bowen recruitment as the “luckiest I’ve been” in 40 years of coaching.

What happened in the weeks that followed that interview in an Indiana gym on April 28 is the subject of an ongoing federal investigation. Pitino has been put on administrative leave and is expected to be fired. Bowen might never play a game of college basketball.
