If Winston is charged, more than a year after the assault and report, it's a gross miscarriage of justice.

If Winston is not charged, after suffering through a false allegation for more than a year, it's a gross miscarriage of justice.

The absolute incompetence and indifference in this case is astounding.  If you've followed this story, you realize that the police tried to make it go away from the very beginning and their behavior has been unprofessional and unethical, if not criminal, since the beginning.

If the evidence was there to charge him, it should have been done and if the evidence was not there, he should have been cleared as a suspect.  Without an anonymous tip and the story-driven media, there still would not be an investigation.

Multiple play-by-play posters followed by "Good job, D" and "Way to go, Offense" is so interesting to read over and over as the team gets blown out and the coaches flounder. I can't figure out why game threads don't have 60 to 80 pages now.

Am I the only one that misses the old, interesting game threads?

I think maybe the victim (if it's not Winston who is the victim) might be interested to know a little something about the proceedings and the public in Tallahassee might want a little transparency on the complete failure of the police in this matter as well.

Ive lived in Tallahasse for over 20 years and neither the TPD nor the State Prosecutor are FSU athlete friendly.  (Think Peter Warrick or Sebastian Janikowski) I'm not saying there wasn't a cover- up but, if there was, it would be out of character for that group.

As you get older, you will learn that the police and Justice department can pretty much do as they please and are immune to the word of law.  Sending one area of law enforcement to investigate another part of law enforcement is like sending a wolf to investigate the possible killing of a baby lamb by another wolf.

No doubt, they can abuse the law.  But, the suggestion is being made that there's a cover-up to protect the program or (at the time), a relatively unknown baseball player who was also on the football team.  All of those allegations are coming from the family.  Not saying they are not true or shouldn't be investigated, but am saying the department and the prosecutor don't have that history.  If anything, it's the opposite.

This isn't any kind of authority on anything, and may just be somebody making up stuff on the internet because he can, but it's a suggested version of events and difficulties in the case for the prosecutor that came out before Thanksgiving:

BRAVO !!!!!! So sick of all these idiots that keep saying its a cover up,TPD and MEGGS are not friends w/ the program. In fact SA (Meggs)has said in the past that he hold athletes to a higher standard.. As a former grad of FSU I saw numerous arrests w/ the football program during the Bowden yrs.

I just want Florida State to beat either Ohio State or Auburn or Missouri or Alabama (whichever one they get), or the last chance of any enjoyment in this college football season will be lost and 2013 will go down as my least favorite season ever.  Not that I'm a Florida State fan, but because I don't hate them like I hate the other 4 teams.

This is a false and irresponsible comment.  The police and the prosecutor are NOT immune from the "word of law" as you call it.   Law enforcement officials do not have absolute immunity and can be subject to both civil and criminal sanctions for improper conduct.  Need I remind you to what happened to the prosecutor who falsely accused the students in the Duke lacrosse case?  As for the U.S. Department of Justice (which I assume you are referring to in your "Justice department" comment), they are a federal agency and this was an investigation of whether there was a violation of a state statute(s).  There could potentially be a federal investigation if there are allegations of state, county, or municipal law enforcement improprieties that would trigger federal offenses or civil rights violations, then USDOJ and the FBI might get involved.  Otherwise, this is a state issue.

So basically they thought this chick was a liar. Sounds like it probably happened the way the article linked earlier said.  Hence the demeanor of the prosecutor.

Friend and I decided to make a porn with a chick.  I stole the tape as I was leaving.  THREE DAYS later she said we raped her.  We go to county lock up and was already told we were serving 10-20 because of "her word against yours".  Bring porn tape in and she STILL swore we raped her.  She even changed her story 3 times.  After prosecuting attorney made her watch the tape with her entire family, she then comes clean.

The prosecutor also stated that the accuser didn't want to name her boyfriend. She didn't want to pursue the case and it looks like someone was pushing her to do so. I don't want to assume anything about the accuser or Winston. But it appears both of them made poor choices that night.
