Worrick Robinson, one of the attorneys in the Vanderbilt University rape case, was in his yard trimming a tree limb when he heard a "pop" in his left shoulder.

Quote"My wife said, 'Oh, you're going to need the chainsaw for that,' " he recalled later. "And, of course, I thought, 'I don't need that. I can do that myself.' "

But the "pop" injury worsened, and the required surgery scheduled for next week will delay the start of the trial until January. Robinson represents Cory Batey, who is standing trial with Brandon Vandenburg. The two former Vanderbilt football players are accused of raping a 21-year-old woman in June 2013.

"In this profession we sacrifice a lot," Robinson told reporters, mentioning ballgames and recitals. "But I've never had a situation where it would — putting my client first — would impact me for the rest of my life. So I'm going to listen to my doctor, and I'm going to think about my family first this time, and my health."

The injury was first an issue Monday, delaying start of jury selection for four hours. In court Tuesday, Robinson suggested the young men could go to trial separately or asked the case be pushed back.

Attorneys for Vandenburg objected in part. Albert Perez Jr. said proceeding separately would jeopardize Vandenburg's right to a fair trial because they've prepared for a joint proceeding.

"I cannot, as Mr. Vandenburg's lawyer and one of his team members, proceed with witness examination," he told Judge Monte Watkins. "Mr. Vandenburg will suffer."

A judge is expected to rule by the end of the week whether to allow a doctor to testify about intoxication in the defense of Cory Batey, one of four former Vanderbilt University football players accused of raping a woman last year.

Batey's attorney, Worrick Robinson, said it "would be critical to the jury to hear testimony from Dr. Walker on the effects of alcohol and the impulsive behavior that results." In an interview with media after the court hearing, Robinson said it was more than just Batey who was intoxicated and whose judgment might have been impaired.

Police say Vandenburg and a 21-year-old woman were drinking the night of the alleged rape. In the dorm room, police allege Vandenburg, Batey and two others raped and sexually abused the woman.

Prosecutor Roger Moore said that intoxication is not a legally valid defense in some of the charges against Batey. He said the doctor's testimony may be relevant later in the case, but not in front of a jury that can use common sense to determine the effects of intoxication.

"We need to connect the idea of sexual misconduct to the sanctions that can result from it — we need to know that the administration isn't afraid to sanction those who fail to take personal responsibility for obtaining consent and respecting others," Spear said.

The issue of accountability, however, has created tension in the national dialogue on sexual violence. Many legal experts argue that the standard of "more likely than not" — the standard required for sanctions for sexual misconduct at most schools, including Vanderbilt — puts too much weight on the accused to show that they are innocent in situations that are often clouded with alcohol use and confusion about what defines consent.

Regardless of those concerns, however, many activists feel that communicating — and following through with — punishment procedures is important on campus.

"There should be more punishment on campuses because the standard isn't as high, but there are less, there are fewer," said Anna Carella, a political science graduate student. She added that it would be naive to believe that it would be sufficient to encourage positive behavior simply because we "care about morality."

The university handbook outlines the process for the adjudication of claims of sexual misconduct. However, no information, including the judicial resolution of cases, is released by the university.

Vanderbilt's internal handling of reports has come under fire recently. The university is one of a few dozen schools currently being investigated by the U.S. Department of Education's Office for Civil Rights in a compliance review. Complaints filed in November 2013 by students and alumni — who detailed problems with their individual cases in their complaints — contributed to the decision to launch the investigation, according to a Department of Education spokesman.

A final hearing is set for Friday just days before the expected start of trial of two former football players accused of raping a woman at Vanderbilt University.

Brandon Vandenburg, 21, and Cory Batey, 20, face charges of aggravated rape and aggravated sexual abuse. Police say they and two other former football players raped an unconscious 21-year-old female student in a dorm on June 23, 2013.

Vandy rape trial to begin; case seen as victim 'catalyst'

On Oct. 3, 1995, a California jury found O.J. Simpson not guilty of murdering his wife.

Almost 19 months ago, four men allegedly carried a woman into a dorm room at Vanderbilt's Gillette Hall.

That's where police say the men raped the 21-year-old female student while she was unconscious.

Those accused of rape and other counts are: Brandon Vandenburg, now 21; Cory Batey, now 20; Brandon E. Banks, now 20; and Jaborian "Tip" McKenzie, now 20.

They were football players and underclassmen. The incident cost them their enrollments. Depending on the outcome of trial, whatever happened that night could also cost them their freedom.

While the shared case file belonging to Vandenburg and Batey contains thousands of pages of documents, those of Banks and McKenzie remain thin. Banks and McKenzie are expected to testify in their former teammates' case.

Witnesses identified, jurors axed as Vandy rape trial starts

Those three were among 50 potential jurors who filed into a courtroom Monday morning to begin a slow process picking the jury that will hear evidence in the case against Brandon Vandenburg, 21, and Cory Batey, 20. The men are accused of raping a female student in a dorm in June 2013.

Judge Monte Watkins read the names of potential witnesses to jurors to check for any conflicts. It is the first time the names have been publicly released.

Expected to testify are the alleged victim, Vanderbilt administrators, about a dozen police officers, students who were friends of the victim and several football players. James Franklin, former Vandy football coach whose reaction to the reported rape faced scrutiny, was not on the list.

Attorneys peppered potential jurors with questions about whether they consider the suspects innocent until proven guilty, their use of social media and views on whether alcohol was morally wrong. Assistant District Attorney Jan Norman asked jurors if they knew about criminal responsibility and that someone could be guilty if they aided someone else in committing a crime.

Fletcher Long, one of Vandenburg's attorneys, referenced the 1957 movie "12 Angry Men." It tells the story of jury deliberations in a murder case and a man — portrayed by Henry Fonda — who does not let other jurors sway his opinion.

Long asked each potential juror the same question: "Are you a Henry Fonda, or do you just go along with the crowd?"

DA: Victim in Vanderbilt rape case experienced 'worst nightmare'

A woman studying at Vanderbilt University was a member of the dance team and "in a good place" until June 23, 2013.

"Little did she know that day that held such great promise for her would turn into her worst nightmare," Thurman said.

In 19 minutes, Thurman gave a graphic and blunt account of what four former football players are accused of doing to the woman that day: raping and sexually assaulting her in a Vanderbilt dorm room while she was unconscious, and then trying to cover it up.

Prosecutors and defense attorneys gave opening statements in the trial of two of those players on Tuesday, laying out a road map of evidence and giving additional insight into their cases.

Videos and photos of the alleged incident — and witnesses who will explain what the video shows — will be key to the prosecutors' case. DNA evidence probably won't play a major role.

Meanwhile, defense attorneys will jump on the lack of DNA evidence, and in their opening statements pointed fingers at other people charged in the case who are expected to testify. They told jurors to carefully consider the credibility of those witnesses.

Alcohol, too, is expected to play a role in the defense, in terms of how much the alleged victim had the night of the incident, where she got it from and how it would have affected the suspects' judgment.

Thurman said trial evidence would show Brandon Vandenburg, 21, and Cory Batey, 20, are guilty of five counts of aggravated rape and two counts of aggravated sexual battery, the charges against them. Vandenburg also is charged with tampering with evidence and unlawful photography.

While Thurman spoke, the alleged victim sat in the courtroom's public seating area. She wiped her eyes with tissues and occasionally held hands with the women sitting next to her. Vandenburg and Batey — seated a few feet from their family members, who filled two rows of benches — remained stoic.

Girls that drink until they pass out....should still be able to expect their 'dates' to not rape them. And/or share them with their buddies.

Just because she's helpless, doesn't mean she's 'fair game'. In fact, it means just the opposite. If she's helpless, she should be treated with MORE care, not less.
