when my mother died she had a living trust and everything went well at her passing but she had alot more property than I do.  62 years old with paid for home and business (I am only employee)  wife and no kids.   I have to have one or the other in next few weeks so your advice is needed.  Thanks

I'm a big fan of trusts. While a will is better than nothing, the majority of the time everything will go through probate once the second spouse has passed away. The cost of a trust isn't that bad at all, and typically will include powers of attorney, living will, etc. This can be very important when someone becomes incapacitated but still living. The vast majority of your credible estate attorneys should give you a no cost consultation on both options, and the pros and cons of each.
