Houston Nutt accuses Ole Miss of running ‘smear campaign’ threatens to sue

I called Nutt after reading the response of his former school, Ole Miss, to the NCAA's notice of allegations that was released earler in the day. [Full disclosure: I worked with Nutt for two seasons at CBS.] In that release, it was alleged by the NCAA — and agreed upon by Ole Miss — that "serious violations have occurred." The response also pointed out that the majority of the 13 violations involving the Rebels football program occurred on coach Hugh Freeze's watch. Not on Nutt's, which is what sources inside Ole Miss had intimated to several reporters, including myself, months ago.

Those sources said in late January that the majority of the allegations stemmed from women's basketball, track and field and the Nutt regime, which technically is accurate since nine of the 28 total violations against the Rebels athletic program were on Freeze. But I can see why Nutt felt a measure of vindication after seeing how he was getting the blame despite the fact that nine of those 13 violations happened under his successor.

"It's the most frustrating thing there is," Nutt told FOX Sports, "to be on the sidelines and hear your name keep getting mentioned and mentioned. It's hurtful. It makes you mad.

"I don't have a major violation in 30 years of coaching.

"I'm going on five years without a team," he said. "There were a few opportunities I went after. I'd love to coach again. I feel like I've got 10 more seasons in me."

The 58-year-old Nutt said he didn't know much of the specifics about the fraudulent ACT tests. Back then Nutt wasn't counting on those recruits to be on his 105-man roster.

"We usually know about who is going to make it in by May," he said. "We were gonna place them in junior college."

Instead, they did get in. Nutt still has a hard time believing his assistants cheated, he says.

"There's not a better person to have around your son than (Chris Vaughn)," he said. "I recruited him out of Tallahassee. He played for me at Murray State. Coached for me all those years at Arkansas and Ole Miss. I mean did he feed 'em? But outright cheating? I don't think that's in his DNA."

In February, Vaughn was dismissed from his job as Texas' defensive backs coach due to the allegations at Ole Miss.

Houston Nutt: 'My intention was not to bring Hugh Freeze down'

"That wasn't my intention. My lawyer found things, but my intention was that I wanted my name clear. Because that's all I have. I'm sitting on the sideline, working for CBS, I get to watch football the greatest game there is."

Freeze resigned this offseason after phone records showed a pattern of calls to a Tampa, Fla.-based escort service from a university phone. The phone records surfaced as a result of Nutt's lawsuit against Ole Miss.

Nutt filed for defamation against Ole Miss after he claimed the university ran a recent smear campaign against him. Nutt hasn't coached Ole Miss since 2011.

Ole Miss publicly apologizes to Houston Nutt, settles lawsuit

The school announced the settlement -- terms of which were not disclosed -- with a brief statement issued Monday on behalf of both Nutt and Ole Miss. The statement read:

"The lawyers who represent the University and Coach Nutt have communicated during the past few weeks to reach an agreement that would allow the parties to resolve Coach Nutt's claim while avoiding the costs and distractions associated with further litigation. The parties have reached such an agreement."

Nutt sued Ole Miss in July and re-filed the suit in state court last week after a federal court judge dismissed it. Nutt, who coached at Ole Miss from 2008-11, claimed in his lawsuit that former coach Hugh Freeze, athletics director Ross Bjork and other athletics department officials violated a separation agreement with Nutt by making disparaging comments about him to the media in the wake of NCAA allegations against the school.

Ole Miss also apologized publicly to Nutt on Monday, with the apology reading as follows:

"Certain statements made by University employees in January 2016 appear to have contributed to misleading media reports about Coach Nutt. To the extent any such statement harmed Coach Nutt's reputation, the University apologizes, as this was not the intent. The NCAA's Notice of Allegations dated January 22, 2016, did not name or implicate Coach Nutt in any misconduct, and it would have been inappropriate for an University employee to suggest otherwise."

Ole Miss apologized and ended its three-month legal spat with Houston Nutt

QuoteOXFORD — The three-month legal saga between Houston Nutt and Ole Miss reached its conclusion Monday afternoon.

In a joint statement, both parties announced a settlement in Nutt's lawsuit, which was filed in federal court in July, dismissed in August, then refiled in Lafayette County Circuit Court last week.

"The lawyers who represent the University and Coach Nutt have communicated during the past few weeks to reach an agreement that would allow the parties to resolve Coach Nutt's claim while avoiding the costs and distractions associated with further litigation," the statement said. "The parties have reached such an agreement."

Nutt filed the lawsuit, which alleged a breach of contract, a breach of duty of good faith and fair dealing, and sought punitive damages, in response to an alleged misinformation campaign led by Hugh Freeze and Ole Miss officials after the arrival of the university's Notice of Allegations from the NCAA's enforcement staff in January 2016.

Both complaints filed by Nutt outlined calls made by Ole Miss officials to several journalists around the time the university received its notice.

Thomas Mars, Nutt's Arkansas-based attorney, has consistently stated he wanted an apology — and sometimes more than that — from the university for what he considered a smear campaign against his client.

"Certain statements made by University employees in January 2016 appear to have contributed to misleading media reports about Coach Nutt. To the extent any such statements harmed Coach Nutt's reputation, the University apologizes, as this was not the intent," the university said in a statement. "The NCAA's Notice of Allegations dated January 22, 2016, did not name or implicate Coach Nutt in any misconduct, and it would have been inappropriate for any University employee to suggest otherwise."

Throughout the past few months, the university didn't feel an apology or any further compensation for Nutt was necessary.

When asked if any compensation was included in the settlement, lawyers from both parties declined to say anything more than their statements.

n a statement, Nutt said: "I am pleased to put the lawsuit behind me. Best wishes to the future of the Ole Miss Football program."

Freeze was the main casualty of this lawsuit.

Depending on what happens, players may be able to transfer without penalty. If there's no additional bowl ban, that won't be the case. Either way, some players and families aren't taking chances.

Safety Deontay Anderson retained the services of Houston Nutt's attorney, Thomas Mars, and claimed he was misled about Ole Miss' NCAA infractions. Anderson, who redshirted this season, requested his release and was granted a full one by Ole Miss.

Mars confirmed that Anderson wasn't the Ole Miss player/family who has retained his services on Monday and said: "As of this evening, it's more than one, but less than 11."
