Auburn receives federal subpoena in FBI's NCAA basketball investigation  https://trib.al/QdOe13F

QuoteFOIA: Auburn confirmed it has received a federal grand jury subpoena in regards to the ongoing FBI investigation into corruption in NCAA basketball.

"Generally federal grand jury subpoenas are sent with the understanding that they will be treated confidentially both as to whether receiver or as to content so as to avoid interfering with or impeding the investigation," a university spokesman said in a statement to AL.com. "Auburn had pledged full cooperation with the United States Attorney's Office for the Southern District of New York. Given it is already known that at least one other institution received a subpoena we confirm we did too but will otherwise honor the pledge by not producing the content while the investigation is ongoing."

On Wednesday, The Oklahoman reported that Oklahoma State also received a federal grand jury subpoena as it relates to the investigation.

Person is alleged to have accepted $91,500 in bribes over a 10-month period in exchange for steering a pair of unnamed Auburn basketball players to a crooked financial adviser who, unbeknownst to Person, was a cooperating federal witness. Auburn president Steven Leath told AL.com on Sept. 29 that the university has a "pretty good indication" of who the two players referenced in the federal complaint against Person are, but he declined to identify them.

Scarblog: Feds take it up a notch in their probe of Auburn basketball

QuoteFOIA: If Chuck Person was a rogue assistant coach out to make a quick buck off the pro potential of an Auburn basketball player or two, we're probably going to find out.

If Bruce Pearl was unaware of the alleged actions that led to Person being charged with six federal crimes in an FBI bribery and conspiracy case that rocked college basketball far beyond Auburn, we're probably going to know.

If Person was an outlier as Pearl and the rest of the program tried to play by the rules, we're probably going to learn that, too.

At least, that's what Auburn has to hope.

The university acknowledged Thursday, in response to a Freedom of Information Act request from AL.com, that it's received the kind of document no program wants to find in its mailbox.

It's not a request for information from the NCAA enforcement staff. It's worse. It's a subpoena from a federal grand jury for the Southern District of New York.

Auburn didn't share the contents of the actual subpoena but did acknowledge "it is already known that at least one other institution received a subpoena." That school, Oklahoma State...

A federal grand jury in New York in seeking documents from Auburn

QuoteAUBURN, Ala. — Auburn has received a federal subpoena from a grand jury in New York related to the FBI's investigation into college athletics that resulted in the arrest of assistant basketball coach Chuck Person on bribery and corruption charges.

"Auburn has pledged full cooperation with the United States Attorney's Office for the Southern District of New York," a university spokesperson said.

Auburn will not provide further details on the documents the United States Attorney's Office has asked for in recent days.

"Generally federal grand jury subpoenas are sent with the understanding that they will be treated confidentially both as to whether received or as to content so as to avoid interfering with or impeding the investigation," a spokesperson for the Auburn athletics department said. "Auburn had pledged full cooperation with the United States Attorney's Office for the Southern District of New York. Given it is already known that at least one other institution received a subpoena we confirm we did too but will otherwise honor the pledge by not producing the content while the investigation is ongoing."

Uncertainty remains around the eligibility status of two unnamed Auburn basketball players, but clarity could be coming soon

QuoteAuburn coach Bruce Pearl said "before the season starts, the school will absolutely vet everyone on its roster and indefinitely sit anyone that has any eligibility issues, if they arise."

Following Wednesday's practice, Pearl claimed to be unaware if he said that to CBS, which did not directly quote the fourth-year Auburn coach in its preseason ranking of 351 college basketball teams.

"I'm certain that as it relates to guys that are eligible to play, if they're eligible to play they'll play. If they're not, they won't," Pearl said. "So every year you go through a vetting process and you determine eligibility. ... If there are other issues that could place their eligibility in question, they need to go through the process of vetting. So yes, I would certainly be confident that nobody would play unless they're eligible."

Last month, Auburn president Steven Leath told AL.com the school has "a pretty good indication of which students have been identified" in the federal complaint against assistant coach Chuck Person and co-defendant Rashan Michel, but Pearl maintains he is unaware of the identities of the two players mentioned.

QuoteChuck Person and co-defendant Rashan Michel were indicted on six charges by a federal grand jury in New York on Tuesday, according to court documents.

Person, who is facing six charges for fraud, bribery and conspiracy, is accused of receiving $91,500 in bribes from a federal cooperating witness, who has since been identified as former Pittsburgh-based financial advisor Marty Blazer.

The indictment states Person, Michel and others "participated in a scheme whereby bribes were solicited from and paid by a financial advisor and business manager to Person ... and such bribe payments were facilitated by Michel. In exchange for the bribes, Person agreed to exert, and did exert, his influence over student-athletes under his control to retain the services of the bribe-payors once the athletes eventually entered" the NBA."

Person and Michel were among 10 men arrested by the FBI on Sept. 26 as part of a joint investigation with the U.S. Attorney's Office into what it believes is "criminal influence of money" in college basketball.

Auburn offered full refunds to season-ticket holders following Person's arrest and approximately 200 fans sought them, though coach Bruce Pearl said they were later resold. Auburn was still offering refunds to season-ticket holders as of Thursday.
